Terms and Conditions of Frontdesk Rentals

1) Acceptance of the Terms

By accessing and using frontdeskrentals.holidayfuture.com (the “Site”), you accept these Terms and Conditions. If you do not agree, please do not use the Site.

3) Definitions

User/Client/You: the person who browses, consults, or makes bookings.

Content: texts, images, logos, trademarks, software, and other materials on the Site.

Booking: a lodging request and/or confirmation made through the Site’s booking engine.

4) Scope

These Terms govern use of the Site and, where applicable, the general terms of bookings made online. The specific commercial conditions shown during the booking process (rates, taxes, cancellation policies, deposits, etc.) prevail over any general provision of this document.

5) License to Use the Site

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You are prohibited from:

• Publishing, reproducing, distributing, or creating derivative works from the Content without written authorization.
• Selling, renting, or sublicensing materials from the Site.
• Extracting data via scraping, data mining, or other unauthorized automated tools.

All intellectual property rights in the Site and its Content belong to Frontdesk Rentals or its licensors.

6) User Conduct

You agree not to:

• Use the Site for unlawful purposes or in ways that infringe third-party rights.
• Introduce malware, attempt intrusions, perform reverse engineering, or take actions that compromise the Site’s security or operation.
• Impersonate others or provide false information in forms and bookings.

7) Accounts and Security (if applicable)

If the Site offers user accounts, you are responsible for keeping your credentials confidential and for all activities under your account. You must notify us immediately of any unauthorized use.

8) User-Generated Content (reviews/comments)

Where the Site allows posting reviews or comments:

• You retain ownership of your posts, but grant Frontdesk Rentals a non-exclusive, worldwide, royalty-free license to use, reproduce, translate, and display such content for operational and promotional purposes of the Site.
• Content that infringes copyrights or trademarks, or that is defamatory, obscene, discriminatory, unlawful, or invasive of third-party privacy will not be published.
• We reserve the right to moderate or remove content that violates these Terms.

9) Links and iFrames

• You may link to our homepage provided the link is not misleading, does not imply non-existent sponsorship or endorsement, and fits the context of the originating site.
• You may not create frames or practices that alter the visual presentation or appearance of the Site without written authorization.
• The Site may contain links to third parties. We do not control and are not responsible for their content, practices, or policies.

10) Information, Availability, and Errors

We make reasonable efforts to maintain the accuracy of information (rates, availability, descriptions). However, typographical errors or variations may occur. We reserve the right to correct any error and update information without prior notice, as well as to cancel bookings affected by obvious errors (with a full refund if you have already been charged).

11) Booking and Payment Process

• Rates are shown in United States Dollars (USD) unless otherwise specified and include/exclude taxes and fees as indicated during the booking flow.
• Booking confirmation is deemed issued when indicated by the system and/or when you receive the confirmation email.
• We may use third-party payment processors. By paying, you accept their terms and policies.
• We reserve the right to refuse or cancel a booking for reasonable grounds (e.g., suspected fraud, policy breach, unavailability).

12) Deposits, Security Holds, and Damages

Some bookings may require a security deposit (refundable under the applicable conditions). You are responsible for damages, losses, or excessive dirt attributable to your stay, and you authorize the charge in accordance with the conditions shown during the booking and/or the lodging agreement.

13) Check-in/Check-out and House Rules

Schedules, access instructions, and house rules (noise, number of guests, use of common areas, events, etc.) will be communicated in the confirmation and/or the property manual. Breaches may result in additional charges or early termination of the stay without refund.

14) Cancellations, No-Show, and Refunds

Cancellation and refund policies are shown during the booking process and in the confirmation. In case of no-show, the charges indicated in the booked rate will apply. Change requests are subject to availability and possible fare differences.

15) Force Majeure

We are not liable for failures caused by events beyond our reasonable control (e.g., natural disasters, widespread power outages, governmental actions, civil unrest, telecommunications failures, or failures of external providers).

16) Data Protection and Cookies

The processing of personal data is governed by our Privacy Policy, available on the Site. The use of cookies is governed by our Cookie Policy. By using the Site, you accept those policies.

17) Limitation of Liability

To the extent permitted by applicable law, Frontdesk Rentals shall not be liable for indirect, incidental, special, consequential, or punitive damages, nor for loss of profits, data, or goodwill arising from the use or inability to use the Site or the stay, except where otherwise required by law. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under law.

18) Indemnity

You agree to indemnify and hold Frontdesk Rentals harmless from claims, damages, liabilities, costs, and expenses arising from your misuse of the Site or breach of these Terms.

19) Modifications

We may update these Terms at any time. The current version will be published on the Site with the last updated date. Continued use of the Site after changes implies acceptance of the new Terms.

20) Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Ecuador. For any dispute, the parties submit to the competent courts of Guayaquil, without prejudice to any mandatory jurisdictions that may apply.
